JUSTICE PARTHA SARTHY ORAL ORDER 03-06-2021 Heard learned counsel for the petitioner and learned A.P.P. for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Navinagar (Badem O.P.) P.S. Case no. 55 of 2020 registered under sections 323, 324, 147, 149, 341, 337, 354, 504 and 506 of the Indian Penal Code to which section 302 of the Indian Penal Code was added subsequently. As per allegation in the F.I.R., eleven named accused persons including the petitioner herein are stated to have come variously armed. They started to abuse and threaten and, thereafter, assaulted the informant and others with brick, Garasa, Lathi etc. It is further stated that Sanjit Ram assaulted with the Garasa. The brother and the Bhabhi of the informant were also beaten up and injured. It is stated by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The case of the petitioner stands on a similar footing to that of three other co-accused who have been enlarged on bail vide order dated 22.2.2021 passed in Cr. Misc. No. 40585 of 2020, order dated 22.3.2021 in Cr. Misc. No. 3871 of 2021 and order dated 15.4.2021 in Cr. Misc. No. 6309 of 2021. The application for bail is opposed by learned A.P.P. for the State.
Having heard learned counsel for the parties and taking into consideration the general and omnibus allegation levelled in the F.I.R., the period in custody and grant of bail to co-accused, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Navinagar (Badem O.P.) P.S. Case no. 55 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate I, Aurangabad.
