The petitioners are apprehending their arrest in connection with Alamnagar P.S. Case No. 107 of 2014 for the offences instituted under Sections 420, 467, 468 and 471 of the IPC.

The prosecution story, in brief, is that the petitioner no. 1 by opening A/C No. 32835278992 obtained the benefit of Indira Awas Yojna of the name of Champa Devi, wife of Santosh Rishideo by cheating and forgery and the petitioner no. 2 has helped the petitioner no. 1 in committing the aforesaid forgery and cheating.

Patna High Court Cr.Misc. No.16736 of 2015 (3) dt.03-09-2015 2/2 It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. The petitioners have been made accused in the present case due to mistake of fact. It is further submitted that the husband of petitioner no. 1 is said to have committed fraud by making fake withdrawal in respect to Indira Awas. It is further submitted that the petitioner are ready to jointly deposit an amount of Rs. 5,000/- in the court below which shall be subject to final disposal of the case. On behalf of the State it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances it is directed that the petitioners shall jointly deposit Rs. 5,000/- in the court below which shall be final disposal of the case and on doing so, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of four weeks from today in connection with Alamnagar P.S. Case No. 107/2014 on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned SDJM, Udakishunganj, Madhepura, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
