2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 25(1-b)a, 26 and 35 of the Arms Act, registered in connection with Yadopur P.S. Case No. 55 of 2024.

3. As per prosecution case, there has been recovery of one mobile phone from the possession of the petitioner and other incriminating articles from co-accused person.

4. The learned counsel for the petitioner has submitted that petitioner has been falsely implicated in this case and has committed no offence. On the basis of suspicion, he has been made accused in this case. No incriminating article/weapon has

Patna High Court CR. MISC. No.55363 of 2024(2) dt.14-08-2024 2/2 been recovered from the conscious possession of the petitioner. Petitioner is a person of clean antecedent and he is in custody since 13.04.2024.

5. Learned APP for the State has opposed the prayer of bail.

6. Considering the above facts and circumstances of the case as well as petitioner having clean antecedent, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Court of A.C.J.M.-III, Gopalganj in connection with Yadopur P.S. Case No. 55 of 2024, subject to the condition that the petitioner shall co-operate in the disposal of trial and make himself available as and when required by the Court.
