JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-04-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 379, 504 and 506/34 of the Indian Penal Code and Section 3 (I) (II) and 3(I)(X) of the SC/ST (Prevention of Atrocities) Act. The accusations are of abusing the informant and his family members by calling caste name, making assault and snatching ornaments.
It is submitted by learned counsel for the petitioners that since long the petitioners' side was complaining to the authority with regard to obstruction and nuisance caused by informant, those complaints have been brought on record as Annexure2(series) and in background of civil nature of dispute, the present
Patna High Court Cr.Misc. No.14364 of 2015 (2) dt.10-04-2015 2/2 accusation has been levelled. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Araria in connection with Araria SC/ST P.S. Case No. 01 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
