JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 12-01-2023 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 341, 323, 324, 307, 302, 120B, 34 of the Indian Penal Code and Section 27 of the Arms Act.

As per prosecution story, the petitioner along with other co-accused persons came at informant door and started destroying the bamboo fencing all informant's door, on protest by informant's bhaisur, the petitioner opened fire upon him but he narrowly escaped. It is further alleged that after hearing the sound of firing, informant's husband rushed there and in the meantime co-accused shot fire upon him thereafter he was

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The informant and petitioner are next door neighbours and a land dispute going on between them due to which he has falsely been implicated in this case. The specific allegation of shot fire is against co-accused Ved Prakash Munmun, who fire upon the informant's husband on abdomen as a result of which he succumbed to injury. Allegation against this petitioner is fired upon informant's bhaisur but he narrowly escaped. It is further submitted that the petitioner is languishing in judicial custody since 1.7.2022.

Learned APP appearing for the state and learned counsel for the informant have vehemently opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Alamnagar P.S. Case No. 67 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate,
