The petitioner is languishing in custody in a case registered for the offences punishable under Sections 341, 323, 324, 325, 147, 149, 436, 307, 504, 506/34 of the Indian Penal Code.

It is a case of assaulting to the informant's side by all the F.I.R named accused persons including the petitioner.

Patna High Court CR. MISC. No.51154 of 2022(3) dt.06-02-2023 2/3 It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. There is counter version of the occurrence also and petitioner's side also sustained injuries. The petitioner is languishing in custody since 12.07.2022. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Learned counsel appearing on behalf of the informant and learned A.P.P for the State have vehemently opposed the prayer for bail of the petitioner and submitted that there is specific accusation against the petitioner that he hit with hockey stick to the head of Vivek Kumar, causing head injury.

Considering the fact that the injury caused by the petitioner to Vivek Kumar is simple in nature and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional
