Petitioner seeks bail in Khizersarai P.S. Case No.125 of 2019 instituted for the offence under Section(s) 341, 323, 307 Indian Penal Code.
Counsel for the petitioner submits that there is case and counter case between the parties. Instant case is counter blast of Khizersarai P.S. Case No.126 of 2019 lodged by the petitioner against informant and others in which petitioner has also sustained injury.
It is alleged in the written report that petitioner and other accused persons arrived in the house of the informant and assaulted father of the informant, brother-in-law of sister of
Patna High Court CR. MISC. No.47884 of 2019(2) dt.07-08-2019 2/2 informant. It is mentioned in the written report that alleged occurrence took place because of firing of crackers by 14 years old brother of the informant.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, IV, Gaya, in connection with Khizersarai P.S. Case No.125 of 2019, subject to the condition that both the bailors shall be close relative of the petitioner. (Sanjay Priya, J) J. Alam/- U T
