JUSTICE MOHIT KUMAR SHAH ORAL ORDER 07-08-2019 The present writ petition has been filed for directing the respondents to remove the encroachment over the public land i.e. over the road, made by the private respondents. Having regard to the facts and circumstances of the case, I deem it fit and proper to dispose off the present writ petition with liberty to the petitioners to approach the Circle Officer, Warisnagar, District-Samastipur by filing appropriate complaint under the provisions of the Bihar Public Land

Patna High Court CWJC No.15954 of 2019(2) dt.07-08-2019 2/2 Encroachment Act, 1056 (hereinafter to be referred as the 'Act 1956') and in case a complaint is filed, the Circle Officer, Warisnagar, District-Samastipur, shall initiate appropriate proceedings under the Act 1956, if maintainable, and after giving opportunity to the encroachers for filing objections, shall pass final order under Section 6 of the Act 1956. The writ petition stands disposed off on the aforesaid terms.
