JUSTICE PRABHAT KUMAR JHA ORAL ORDER 15-05-2015 Heard learned counsel for the petitioner, learned A.P.P. as well as learned counsel for the informant. The petitioner apprehends his arrest in a case under Section 366, 363 and other sections of the Indian Penal Code. The father of the victim made allegation that the petitioner kidnapped his minor daughter but the victim herself made statements under Section 164 of the Code of Criminal Procedure and she disclosed that nobody kidnapped her and she, out of her own will, solemnized marriage with the petitioner. Learned counsel for the informant submitted that the victim is a minor girl but it appears from perusal of the statement of the victim recorded under Section 164 Cr.P.C. that the victim disclosed her age to be 20 years. The court also assessed the age of the victim to be 20 years.
Patna High Court Cr.Misc. No.16792 of 2015 (2) dt.15-05-2015 2/2 Considering the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Pupri at Sitamarhi in Nanpur P.S. Case No. 383/14, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
