JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-11-2019 This is an application for grant of anticipatory bail in connection with Assaon P. S. Case No. 137 of 2018, disclosing offences under Sections 341, 323, 324, 379, 307, 448, 504, 506, 34 of IPC.

As per F.I.R. the petitioner is said to have assaulted the mother-in-law of the informant by Farsa, causing injury. Later on, she succumbed injuries and as such, subsequently, Section 307 has been added.

Submission of the learned counsel for the petitioner is that the F.I.R. has been lodged just after 11 days of the occurrence. There is no corresponding injury on the person of the mother-in-law of the informant.

Heard learned A.P.P. as well as learned counsel for the

Patna High Court CR. MISC. No.49252 of 2019(4) dt.19-11-2019 2/2 informant, who has appeared suo motu has submitted that stitch injury was found on the head of the injured.

Having heard both sides, in view of the facts, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner. However, he has to surrender and pray for regular bail before the learned court below, the same shall be considered on the basis of the materials available on the record, without being prejudiced by order of this Court.
