JUSTICE VIKASH JAIN ORAL JUDGMENT Date: 21-08-2017 The present petition has been filed for transfer of Matrimonial (Divorce) Case No. 187 of 2014 from the Court of learned Principal Judge, Family Court, Nawada to the Court of learned Principal Judge, Family Court, Patna.
2. None appears on behalf of the petitioner despite repeated calls.
3. Learned counsel for the sole opposite party appears and resists the transfer petition submitting that no fruitful purpose will be served in transferring the said Divorce Case to Patna. It is pointed out from para 7 of the petition itself that an FIR has been instituted in Nawada Mahila P.S. Case No. 22 of 2015 in connection with cruelty and torture alleged by the petitioner. It is therefore, submitted that the
Patna High Court MJC No.1010 of 2016 dt.21-08-2017 petitioner would be required to attend the Court at Nawada to prosecute the said case.
