The petitioners apprehend their arrest in Bankey Bazar (Raushanganj) P.S. Case No. 14 of 2013, registered for the offences punishable under Sections 406, 409 and 420 of the Indian Penal Code.

Allegation against the petitioners and others is that they did not pay wages to labourers.

Learned counsel for the petitioners submits that the allegation is false and concocted. The petitioner no. 1 is the ward member and petitioner no. 2 is the husband of petitioner no. 1. Similarly situated co-accused Lallan Kumar Mishra and Ramashish Paswan have been granted bail vide Cr. Misc. No. 25675 of 2013 and Cr. Misc. No. 18070 of 2014 and the case of

Patna High Court Cr.Misc. No.23212 of 2015 (2) dt.08-07-2015 2/2 the petitioners stands on the same footing.

Considering the facts aforesaid, the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Learned Sub-Divisional Judicial Magistrate, Sherghati, Gaya in Bankey Bazar (Raushanganj) P.S. Case No. 14 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
