JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 13-04-2015 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case for the offence under Sections 272 and 273 of the Indian Penal Code and Section 47 (A) of the Excise Act.

About 32 liters of liquor was recovered by the police from the orchard in village Puraina.

Learned counsel for the petitioner submits that one Dharmesh Kumar was arrested with the said pouch of liquors and he stated that before the police that the same belongs to the petitioner. He further submits that the petitioner is a license holder of liquor shop and in fact he was facing loss in business, on account of which he made a complaint against sale of illegal liquor, on the basis of which the raid was conducted.

No.16838 of 2015 (2) dt.13-04-2015 2 / 2 In the circumstances, in the event of arrest or surrender before the court below within four weeks from today the above named petitioner be released on anticipatory bail on furnishing bail bond of Rs.5000/- (Five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bettiah, West Champaran in connection with Jogapatty P.S. Case no. 329 of 2014, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
