The petitioner apprehends his arrest in connection with Kusheshwar Asthan P.S. Case No. 28 of 2019, registered under Section 302 and 201/34 of the Indian Penal Code, pending in the court of the Judicial Magistrate, 1st Class, Biraul, Darbhanga.

The accusation is of killing of the daughter of informant by her husband and in-laws due to birth of three female child and disposing of her dead body.

Learned counsel appearing on behalf of the petitioner submits that petitioner is the father in law of the deceased, daughter of the informant, and he used to reside

Patna High Court CR. MISC. No.47173 of 2019(2) dt.30-07-2019 2/2 separate. Further submission is that, in fact, deceased daughter of informant committed suicide and her dead body was disposed of in presence of the informant. The petitioner has no criminal antecedent.

Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trial Court within four weeks and pray for regular bail, which would be considered by the trial Court in accordance with law without being prejudiced by the order of this Court.
