The petitioner is apprehending arrest in connection with Jurawanpur P.S. Case No. 145 of 2020 under sections 341, 323, 332, 333, 326, 353 and 504 of the Indian Penal Code. As per the prosecution story, the petitioner was needed in a criminal case and accordingly, when his house was raided, he in turn attacked the police personnel and after injuring one of them fled away.

Learned counsel for the petitioner submits that falsity of the FIR could be very well ascertained inasmuch as, the allegation is that the entire police raided the house of the petitioner, he alone managed not only to assault them but also escaped. Actually he worked under a Contractor, as he stopped

Taking into account the facts of the case also also the petitioner is a labourer and ultimately he has to face the trial, this Court is inclined to grant him relief.

Let the petitioner be released on bail, in the event of their arrest or surrender within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IX, Vaishali at Hajipur, in connection with Jurawanpur P.S. Case No. 145 of 2020 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
