Petitioners apprehend arrest in connection with Begusarai Complaint Case No. 131 of 2020 registered for the offence under sections 341, 323, 386, 352, 506 and 504 of the Indian Penal Code and section 27 of the Arms Act. Learned counsel for the petitioners submits that petitioners have not committed any offence as alleged in the first information report and they have been falsely implicated in this case. Both the parties are agnates and are on litigating terms dues to existing land dispute. It is further submitted that on the
Patna High Court CR. MISC. No.57707 of 2022(5) dt.20-04-2023 2/2 alleged date of occurrence the petitioners were present in the Court below for filing his haziri, as is evident from Annexure-3. Petitioners have no criminal antecedent.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, the petitioner, above named, is directed to be released on bail on furnishing personal bond to the satisfaction of Chief Judicial Magistrate Begusarai in connection with Begusarai Complaint Case No. 131 of 2020 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
