JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 09-06-2015 The petitioner apprehends his arrest in Excise G.O. Case No.80 of 2013 (Trial No.2839 of 2013/2467 of 2014) instituted under Section-47 (a) of the Bihar Excise Act for alleged recovery of about 60 liters of illicit liquor.

Learned counsel for the petitioner submits that before entering search and seizure the authorities did not record any reason to believe and the recovery has been made from a different house of a family member. It is also submitted that the recovery was not made from the conscious possession of the petitioner. Be that as it may, in the event of arrest or surrender within four weeks from today, the petitioner, namely, Mahendra Chaudhary, shall be released on bail on furnishing bail bonds of

Patna High Court Cr.Misc. No.17853 of 2015 (02) dt.09-06-2015 2/2 Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Nawada in connection with Excise G.O. Case No.80 of 2013 (Trial No.2839 of 2013/2467 of 2014), subject to all conditions as laid down in Section-438(2) of the Criminal Procedure Code.
