The petitioner apprehends her arrest in connection with G.O. Case No. 13 of 2016 registered under Sections 28, 28A and 28(B) of the Drugs and Cosmetics Act. The accusation is that in course of checking of medical shop of the petitioner, licence and cash memo was not produced and several prohibited medicines were also found in the medical shop of the petitioner.
Learned counsel for the petitioner submits that, in fact, expiry medicines were detected from the medical shop of the petitioner and the same were kept in inside of the shop but with ulterior motive the present case has been lodged with false
Patna High Court CR. MISC. No.59938 of 2019(3) dt.14-10-2019 2/2 allegation. Further submission is that petitioner, who is lady, has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga, in connection with G.O. Case No. 13 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
