JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-08-2018 Heard the parties. The petitioners seek anticipatory bail in connection with Forest Case No. 39F of 2014, registered for offences punishable under Sections 9,11, 27, 29, 31, 50 and 51 of the Wildlife ( Protection) Act, 1972 (Amendment, 2006). As per F.I.R., allegation against the petitioners is that they were distributing the meat of wild pig and some persons were apprehended and the petitioners were succeeded to flee away. Submission of the learned counsel for the petitioners is that they have falsely been implicated only on the basis of suspicion and neither the petitioners were caught at the place of occurrence nor anything recovered from the possession of the

Patna High Court Cr.Misc. No.47814 of 2018 (2) dt.20-08-2018 2/2 petitioners and the petitioners have no criminal antecedents. Learned A.P.P. opposes the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner, above named on surrender or arrest within six weeks be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand)each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st class, Bettiah, West Champaran in connection with Forest Case No. 39F of 2014, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
