1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 126(2), 352, 351(2), 79, 76 and 3(5) of BNS.
4. As per the prosecution case, it is alleged by the informant that petitioner on a daily basis in the morning does masturbation by showing informant and other girls in front of their house. Petitioner even call the informant and other girls and was offering Rs. 500/- and even used to threaten on protest raised.
5. Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case. The petitioner is suffering from mental illness since long and he was

The act done by the petitioner is neither intentional nor deliberate rather such act was done under unsoundness of mind. Nothing has happened in the manner as alleged in the FIR and no case is made out under Sections 76 and 79 of BNS. It is lastly submitted that the petitioner has no criminal antecedent.
6. Learned counsel appearing for the State has opposed the bail prayer of the petitioner and has submitted that there is specific allegation against the petitioner.
7. Considering the nature and gravity of allegation prayer for bail of the petitioner is rejected. (Prabhat Kumar Singh, J) Prakash/- U
