JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 03-03-2016 Petitioner raised the grievance against her non-selection on the post of a Constable, for which she was an applicant against Advertisement No. 1 of 2012.

The Court directed the respondents, especially the Central Selection Board of Constables to explain the reason as to why the petitioner has not been selected or appointed. It is stated that the reason is attributable to the petitioner and not to the respondents. The petitioner belongs to "Extremely Backward Class of Female Home-guard" category. However, her application which has been annexed as Annexure-D, she declared herself to be only in the category of a "Home-guard".

There is nothing wrong with the decision of the respondents. In fact, they also annexed an order, passed in the case

Patna High Court CWJC No.5973 of 2014 dt.03-03-2016 2/2 of Birendra Kumar, which was C. W. J. C. No. 3992 of 2011, decided on 12.08.2011, annexed as Annexure-F, where this Court refused to interfere with the matter for the reasons indicated therein. Since the facts are identical, writ application is dismissed. No relief can be given to the petitioner, especially when the respondents are not at fault.
