2. The petitioner is in custody in connection with Cyber P.S. Case No. 239 of 2024 for the offence punishable under sections 75, 77, 78, 79, 356(2), 352, 351(3) of the BNS and Section 66(e), 67(A) of IT Act lodged on 26.07.2024 by the informant, Madhuri Devi.
3. As per the prosecution story, the informant alleged that the present accused used to come to her house from time to time and was also talking to her daughter. Her marriage was solemnized in the year 2021 but this petitioner used to post photos/videos on the face-book only to malign her. This led to the FIR.
4. Learned counsel for the petitioner submits that he
Patna High Court CR. MISC. No.51269 of 2025(2) dt.25-07-2025 2/3 has already suffered by being in custody since 29.07.2024 and if granted relief, he shall be diligently appearing in trial and under no circumstance, will have any connection with the lady in question, she being a married.
5. Learned APP, Mr. Bharat Bhushan opposes the prayer for bail submitting that he tried to spoil the marital life of the lady by using the videos/audios/pictures on the website.

Though allegation is there, the petitioner will be facing the consequences, as he has undertaken to diligently appear in trial, and a further undertaking has been given that under no circumstance, he shall be having any truck with the lady and/or the in-laws, is in custody since 29.07.2024, in that background, this Court is inclined to extend him the privilege of bail with conditions.

Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of like amount each to the satisfaction of learned Court of 6th Additional Sessions Judge, Chapra in connection with Cyber P.S. Case No. 239 of 2024 subject to the following conditions: (i) one of the bailor should be the family member/relative of the petitioner who shall provide official document to show his/her bona fide;
Patna High Court CR. MISC. No.51269 of 2025(2) dt.25-07-2025 3/3 (ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself;
(iii) the petitioner shall appear before the concerned police station every fortnight for six months to mark his attendance;
(iv) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;
(v) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds. (Rajiv Roy, J) Vijay Singh/- U T
