Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks regular bail in connection with Bhabhua Mahila P.S. Case No. 30 of 2021 instituted for the offences under Sections 376, 341, 363, 323/34 of the Indian Penal Code read with Section 4 of the Protection of Children from Sexual Offenses Act, 2012.
Learned Senior Counsel for the informant at the very out set submits that trial has commenced and out of nine prosecution witnesses, two have been examined and three private witnesses are yet to be examined apart from other
Patna High Court CR. MISC. No.61276 of 2021(2) dt.22-03-2022 2/2 official witnesses. Learned Senior Counsel further submits that the remaining private witnesses will be appeared before the learned Court below as and when required.
Learned A.P.P. submits that he will inform the authorities to ensure that the official witnesses are present in the trial as and when required.
Based on the submission made by the learned Senior Counsel for the informant, learned counsel for the petitioner seeks permission to withdraw the bail application. Permission is accorded with liberty to the petitioner to renew his prayer for bail in the event if the trial is not concluded within a period of nine months from the date of receipt/production of a copy of this order.
Accordingly, this application is dismissed as withdrawn in connection with the aforesaid case pending in the Court of learned Additional Sessions Judge-VIII-cum-Special Judge, POCSO, Bhabhua, Kaimur/successor Court. (Satyavrat Verma, J) Kundan/- U T
