Petitioner, already in custody, seeks bail in connection with Harlakhi P.S. Case No.109 of 2018, registered under Sections 363, 366(A) and 34 of the Indian Penal Code as well as under Section 4 of the POCSO Act.

Accusation is that while the informant was returning back to home with her daughter, the daughter was kidnapped by one Sabir Nadaf and one unknown boy and later on the girl disclosed the name of some other persons including the petitioner who were found in the car in which she was later on taken away.

Learned counsel for the petitioner submits that the daughter of the informant was kidnapped by Sabir Nadaf and

No.47573 of 2018(2) dt.03-08-2018 2/2 one unknown person but it is a case of elopement and the girl has stated that accused persons left her at Madhubani Railway Station and the petitioner has no criminal antecedent. Having considered the aforesaid facts and circumstances, petitioner Sitesh Mandal @ Sitesh Kumar Mandal is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-cum-Special Judge, POCSO Act, Madhubani in connection with Harlakhi P.S. Case No.109 of 2018 (G.R. Case No.45 of 2018).
