Stand of the State is that all the payments relating to the post retiral dues has been made. 90% provisional pension was sanctioned, but now 100% pension has been sanctioned.
Since the petitioner has created liability himself and he has a first wife living who had already been given benefit of 50% of the salary while the petitioner was in service, the word 'salary' will now be substituted by the word 'pension'. Writ is disposed off.
