Petitioner seeks bail in Turkauliya P.S.Case No. 373 of 2021 registered for the offences punishable under Sections 341, 323, 302/34 of the Indian Penal Code.

As per F.I.R, this petitioner along with two other accused persons assaulted the deceased with lathi and danda as a result of which, wife of informant died.

It is submitted on behalf of the petitioner that the F.I.R has been lodged after four days. There is general and omnibus allegation against the petitioner.

Learned APP of the State opposed the prayer for bail

Patna High Court CR. MISC. No.61666 of 2021(2) dt.15-02-2022 2/2 of the petitioner and submitted that there is specific and direct allegation against the petitioner of assaulting the deceased and during course of investigation, several witnesses have supported the prosecution case, which fact has come in Paragraph 8,9,10 of the case diary.

Considering the nature of allegation, I am not inclined to enlarge the petitioner on bail and hence, his prayer for bail stands rejected.
