This is a petition for grant of regular bail in connection with Buxar (M) P.S. Case No. 168 of 2018 for offences under Section 414 of the Indian Penal Code. Petitioner is apprehended with three persons going on a motorcycle and country made pistol with two live cartridges were recovered from the possession of another co-accused, Sujit Kumar.

It is contended by the learned counsel for the petitioner that he was pillion rider and the motorcycle was being driven by Sujit Kumar, the owner and there is no recovery of any arms from possession of the petitioner, that too is specific against Sujit Kumar and the petitioner was made accused in two

Patna High Court Cr.Misc. No.47616 of 2018(2) dt.03-08-2018 2/2 cases subsequent to the present case. Prior to that he had no criminal antecedent.

Having considered the aforesaid facts and circumstances, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Buxar (M) P.S. Case No. 168 of 2018 to the satisfaction of the Additional Chief Judicial Magistrate- V, Buxar.
