JUSTICE SUDHIR SINGH ORAL ORDER 26-05-2021 Learned counsel for the petitioners is directed to remove the defects, as pointed out by the office, within a period of four weeks from the date of restoration of normalcy. Heard learned counsel for the petitioners and learned counsel for the State through virtual mode.

The petitioners are apprehending their arrest in a case for the offence registered under Sections 341, 323, 354, 307, 379, 504, 506, 448/34 of the I.P.C. and 37(c) of the Bihar Prohibition and Excise (Amendment) Act, 2018. The prosecution story, in brief, is that the petitioners are alleged to have assaulted the informant and other in drunken

It has been submitted by learned counsel for the petitioners that the petitioners have got no criminal antecedent. They have falsely been implicated in the present case. There is no allegation of tampering with the witnesses alleged against the petitioners. The petitioners are alleged to have assaulted the informant and others in drunken state. It has further been submitted that the matter has been compromised between the parties as per statement made in paragraph no. 11 of the petition. The informant has retracted from his earlier statement made in the F.I.R.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R/ Complaint Case. Considering the aforesaid facts and circumstances of the case and also the lockdown, let the petitioners above named, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, be released on anticipatory bail on their personal bond to the satisfaction of the learned Additional Sessions Judge-II-cum-Special Judge, Nawada, in connection with Muffasil P.S. Case No. 59 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
