Learned counsel for the petitioner is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today. The petitioner seeks anticipatory bail in connection with Kawakole P.S. Case No. 22/2021, registered for the offences under Sections 341, 323, 447, 448, 307, 354 (A) (B), 379, 504, 506 and 34 of the I.P.C. of the Indian Penal Code. The main submissions advanced by learned counsel for the petitioner are that the main allegation concerned to assaulting and misbehaviour is not specifically against the petitioner and he is alleged to be a member of the unlawful assembly and both the parties are agnates in between them a land dispute is running. Learned Additional Public Prosecutor opposes the prayer for anticipatory bail and submitted that the petitioner helped the co-accused persons in committing the alleged occurrence by giving them assistance in the entry of the informant's house.

Having considered the above submissions, the facts and circumstances of this case and the nature of allegation appearing against the petitioner and the said land dispute between the parties, let the above named petitioner in the event of his arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Ivth, Nawada in connection with Kawakole P.S. Case No. 22/2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
