2. The petitioner seeks bail in a case registered for the offence punishable under Sections 304B, 201 and 120B of the Indian Penal Code.
3. It is a case of "dowry death".
4. It is submitted by learned counsel for the petitioner that petitioner is mother-in-law of the deceased. Petitioner is victim of over implication. There is no specific allegation of demand of dowry or torture. Petitioner is separate in mess & property and has got no concern with the affairs of the deceased and her husband. Thrust of accusation is against husband of the deceased. Moreover, charge-sheet has already been submitted
Patna High Court CR. MISC. No.57190 of 2024(2) dt.06-09-2024 2/2 and petitioner is in custody since 26.04.2024. Petitioner claims clean antecedents.
5. Learned A.P.P. for the State and learned counsel appearing on behalf of the informant have vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the aforesaid facts and circumstances of the case, period of custody and clean antecedents of the petitioner, the prayer for grant bail of to the petitioner is allowed.
7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge XXIV, Patna, in connection with Rail Bihar Sharif P.S. Case No. 1 of 2024.
