Mr. Abhay Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 14-10-2025 Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offence under Sections 126(2), 115(2), 110, 308(3), 352, 351(2), 3(5) of the Bhartiya Nyaya Sanhita.
3. As per F.I.R., on 13.05.2025, when the informant was unloading soil on his land for the purpose of construction of house, these petitioners came there and demanded extortion of Rs. 50,000/- from the informant and when informant refused to pay extortion money, the petitioners assaulted him with Lathi.
Patna High Court CR. MISC. No.49784 of 2025(3) dt.14-10-2025 2/2 It is further alleged that when informant's son came for rescue, he too was assaulted by these accused-petitioners by Khanti causing injury on his head.
4. Learned counsel for the petitioners submits that both parties are agnates. On account of land dispute, Maarpit took place in which both sides sustained injury. Case and counter case. Injuries, caused by petitioners, are simple in nature. Petitioners claim clean antecedent.
5. Learned A.P.P. for the State has opposed the bail petition.
6. Considering the nature of injury and clean antecedent, let the above named petitioners, in the event of their arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Belhar P.S. Case No. 139 of 2025, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.
