JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-07-2019 This is an application for grant of anticipatory bail in connection with Gardanibag P. S. Case No. 139 of 2019, disclosing offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
Police got an information that petitioner and other accused persons are engaging in trade of liquor, on that raided at the place, the accused persons succeeded in fleeing away from the spot. It is further alleged that from the tent house, there is recovery of 4.5 liters of illicit liquor.
Submission of the learned counsel for the petitioner is that there is no source of recovery of above liquor has been mentioned. Further submission is that he has no criminal antecedent.
Heard learned A.P.P. also, who has opposed the prayer
Patna High Court CR. MISC. No.47745 of 2019(2) dt.31-07-2019 2/2 for anticipatory bail on the ground that liquor was not recovered from the house of the petitioner or from his conscious possession.
Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Special Judge, Excise, Patna, in connection with Gardanibag P.S. Case No. 139 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) Sunil Shukla/- U T
