The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 364(A)/34 of the Indian Penal Code.

The accusation is of kidnapping the minor son of the informant for ransom demand of rupees ten lakhs. It is submitted by learned counsel for the petitioner that F.I.R has been registered against unknown. The victim boy in his 161 Cr.P.C statement has not named the petitioner rather named co-accused Gopi Kumar @ Kallu and Anuj Kumar @ Aaryan who have been arrested who named the petitioner as their

Patna High Court CR. MISC. No.61580 of 2021(3) dt.05-07-2022 2/2 companion. There is no material evidence against the petitioner and on the basis of confessional statement of the co-accused, the name of the petitioner came into light which is not admissible in the eyes of law. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Asthawan P.S. Case No. 291 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
