The petitioner apprehends his arrest in a case under Sections 376 and 511 of the Indian Penal Code. The father of the victim male allegation that while his daughter was grazing goat, Ram Daras Sahani (the petitioner) caught her and took her inside the orchard and made an attempt to commit rape with her after striping off her clothes. It is submitted that the parents of the victim is in the habit of filing such cases but no such document is brought on record.

Considering the fact that there is a very specific allegation against the petitioner that he made an attempt to outrage the modesty of the minor girl, I am not inclined to enlarge the above named petitioner on anticipatory bail in Muffasil P.S. Case

Patna High Court Cr.Misc. No.16944 of 2015 (3) dt.06-07-2015 2/2 No. 121 of 2014. Accordingly, the same is rejected. The petitioner is directed to surrender in the court below within four weeks from the date of receipt / production of a copy of this order and make prayer for regular bail. The court below shall consider the prayer for regular bail of the petitioner on its own merit, without being prejudiced from this order. (Prabhat Kumar Jha, J) Dilip/- U T
