JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-08-2019 Petitioners seek bail in anticipation of their arrest in connection with Turkauliya P.S. Case No. 287 of 2019 registered for the offences punishable under Sections 363 and 366A of the Indian Penal Code. Prosecution story is that minor daughter of the informant was traceless and later on he came to know that she had gone along with one Aashanand Patel and family members of Aashanand Patel got her kidnapped for the purpose of marriage with Aashanand Patel. The petitioners are mother, brother and sister of the said Aashanand Patel. Submission of learned counsel for the petitioners is that except suspicion there is nothing against them and as a matter of fact the victim girl is a major and she has solemnized marriage with Aashanand Patel and she has sworn an affidavit before Notary Public. In view of above facts and circumstances, let petitioner Nos. 1 and 3, being ladies, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran, Motihari, in connection with Turkauliya P.S. Case No. 287 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned. So far petitioner No.2 is concerned, he should surrender and pray for regular bail.
