1. Heard learned Counsel for the parties concerned.

2. The present writ application has been filed for a direction to the respondent authorities to remove the encroachment from the public land, bearing Khata Nos. 399 and 394, Plot Nos. 2249 and 1804, ad measuring 0.3490 hectare, situated in village Dumraon, Ward No. 6 (old) and 19 (new), Circle Dumraon, in the district of Buxar.

3. Learned Counsel for the petitioner submits that in Encroachment Case No. 23 of 2020-21, the Circle Officer, Dumraon, has passed the order, dated 15.12.2020, directing the encroachers to vacate the public land encroached by them.

4. Learned Counsel for the State submits that a counter affidavit has been filed on 27.08.2023, stating therein that the order passed by the Circle Officer, Dumraon, has been implemented and all the encroachments have been removed from the pubic land.

5. In view of the aforesaid submission, learned Counsel for the petitioner seeks permission to withdraw this application.

6. Permission is granted.
