Mr. Binod Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-08-2025 Heard learned counsel appearing on behalf of the petitioners and learned APP appearing on behalf of the State.

2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 189(4), 189(6), 189(7), 189(8), 190, 191(2) and 191(3) of the B.N.S..

3. As per prosecution case, informant, namely Krishna Kumar, alleged that on 19.12.2024, he received information regarding fighting and firing between two groups on account of land dispute and when informant, along with police party, reached at the place of occurrence, all the F.I.R. named accused

Patna High Court CR. MISC. No.49168 of 2025(2) dt.19-08-2025 2/3 persons, including these petitioners, fled away with arms and ammunition. It is further alleged that one car was seized at the place of occurrence.

4. It is submitted by learned counsel appearing on behalf of the petitioners that petitioners are quite innocent and have committed no offence. Petitioners have falsely been implicated in this case merely on suspicion. No illegal arms or ammunition has been recovered from possession of these petitioners. Petitioner No. 1 has got one criminal antecedent in which he is already on bail and Petitioner No. 2 has got no criminal antecedents.

On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioners and submitted that petitioners are named in the F.I.R. with specific accusation that they, along with other accused persons, were fighting and firing due to land dispute. Petitioner No. 2 is registered owner of the seized vehicle and these petitioners were seen fleeing away from the place of occurrence with arms and ammunition. Petitioner No. 1 has got one criminal antecedent of similar nature.

6. Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.49168 of 2025(2) dt.19-08-2025 3/3 and nature of accusation, the prayer for grant of anticipatory bail to the petitioners is rejected.
