JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 09-01-2017 This application, under Section 19 (4) of the Family Court Act, has been filed against an order, dated 16.04.2014, passed by learned Principal Judge, Family Court, Nalanda at Biharsharif, in Maintenance Case No. 23M of 2012, whereby, he has directed the petitioner to pay a sum of Rs. 7,000/- per month each to opposite party No. 2 and her minor daughter (opposite party No. 3). So
Patna High Court CR. REV. No.599 of 2014 (6) dt.09-01-2017 2/3 far as the arrears are concerned, the petitioner has been directed to pay a sum of Rs. 10,000/- on monthly installment basis.
I have heard learned counsel for the petitioner, learned Additional Public Prosecutor for the State as well as learned counsel appearing on behalf of the opposite parties.
With the consent of the parties, the present order is being passed.
So far as maintenance is concerned, it has been agreed between the parties that the petitioner shall pay to opposite party No. 2 a total sum of Rs. 4,50,000/- for maintaining herself and opposite party No. 3, whereafter, opposite party Nos. 2 and 3 shall not claim any amount for further maintenance. As regards their matrimonial dispute, it will be open to them to take steps to resolve it. It is also agreed between the parties that the said amount of Rs. 4,50,000/- shall be paid to opposite party No. 2 in monthly installments, beginning from 2nd February, 2017. First five installments of Rs. 80,000/- shall be paid in the first week of each month, first being on 2nd February, 2017. The last installment of a sum of Rs. 50,000/- shall be paid in first week of July, 2017. This disposes of this application.
