The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 302, 201, 120B, 498A/34 of the Indian Penal Code and section 3/4 of the Dowry Prohibition Act.

Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office. It is a case of dowry death due non-fulfillment of dowry demand.

Learned counsel for the petitioner asserted about the husband of the deceased is in judicial custody.

Learned counsel for the informant and learned APP for the State vehemently opposed the prayer of anticipatory bail petition.

It is also submitted on behalf of the learned counsel for the petitioner that on similar footing Hadisan Khatoon mother in law of the deceased is getting privilege of regular bail. In the above facts and circumstances of the case, let the petitioner, above named, in the event of her arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of S.D.J.M., Katihar in connection with Pranpur (Roshna) P.S. Case No. 51/2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
