JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 02-11-2022 This application for regular bail arises out of Kudhani (Turki O.P.) P.S. Case No. 452 of 2019, disclosing offence punishable under Section 392 of the Indian Penal Code. The petitioner's application for grant of regular bail was earlier rejected by this Court's order dated 08.09.2021 passed in Cr. Misc. No. 33003 of 2021 with an observation that the petitioner shall be entitled to renew his prayer for bail after expiration of six months if in the meanwhile there was no substantial progress at the trial.

Learned counsel appearing on behalf of the petitioner has submitted that he was not named in First Information Report and during the course of investigation his name surfaced, based on confessional statement of a co-accused. He has further

Upon perusal of the present application it is noticed that the petitioner has a criminal antecedent of being accused in a case registered for commission of offence punishable under Sections 379 and 511 of the Indian Penal Code. Considering, however, the circumstance that the petitioner is in custody since 11.08.2019 and the submission made on behalf of the petitioner that there is no progress at the trial, this application is allowed.

Let the petitioner, Amit Kumar @ Vikki Kumar, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateIIIrd, Muzaffarpur West, District- Muzaffarpur in Kudhani (Turki O.P.) P.S. Case No. 452 of 2019.
