The petitioners apprehend their arrest in Katihar (Muffasil) P.S. Case No. 77/2018, instituted for the offences punishable under Sections 448, 341, 323, 324, 307 and 354(B)/34 of the Indian Penal Code.
It is alleged in the written report that the niece of the informant had gone to attend call of nature at night but she was abducted by Petitioner no. 2 and two other accused persons, namely, Kali Singh and Gurudev Parihar. On search, the niece of the informant could not be traced out. The informant along with his family members went to Police Station where one Bechan Singh told that he will produce the girl within two hours. The niece of the informant was released by accused persons after two hours. The
Patna High Court Cr.Misc. No.37015 of 2018 (4) dt.26-07-2018 2/3 niece of the informant was taken to Mahila Police Station and case was lodged. It is further alleged that in the meantime petitioners along with other accused persons armed with weapon arrived and on the order of Sunita Devi, they assaulted the informant and his family members causing injury to them. The informant was brought to Sadar Hospital, Katihar for treatment in serious condition. Learned counsel for the petitioners has submitted that there is case and counter case between the parties. The injury has been sustained by both sides.

Learned Additional P.P. has opposed the prayer for bail of the petitioners. He has submitted that the informant has sustained two injuries on his head caused by hard and blunt substance, which is grievous in nature.
Considering the facts and circumstances of the case, the prayer for bail of the petitioners is rejected. The petitioners may surrender before the court below and seek regular bail, which shall be considered by the court below in accordance with law without being prejudiced by this order.
