Petitioners apprehend their arrest in a case registered for the offence punishable under Section 323, 387, 420 and some other ancillary Sections of the Indian Penal Code. As per the prosecution case, these petitioners along with other accused persons are alleged to have abused the informant, demanded Rangdari and also committed Mar-pit with him.

Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in

It is further submitted that specific accusation of assault is against co-accused, Suresh Prasad and so far these petitioners are concerned, accusation is general and omnibus. All the Sections are bailable except Section 387 & 420 of the IPC which are not attributed to these petitioners. Learned counsel appearing for the State an the informant opposed the prayer for anticipatory bail. Considering the facts of the case and nature of accusation against the petitioners, let the petitioners, above named, in the event of their arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Patna City in connection with Didarganj PS case No. 104/ 2021, subject to conditions laid down u/s 438(2) of the Cr. P. C.
