The petitioner, already in custody since 30.01.2018, seeks bail in connection with Garkha P.S.Case No. 241 of 2018 registered under Sections 323, 341, 376, 379, 506 and 120B of the Indian Penal Code.

Accusation in brief, is that, petitioner, being brother-inlaw (Devar) of the complainant, established physical relation after death of her husband on the pretext of getting married with her and also used to exploit her sexually but refused to marry. Contention of the learned counsel for the petitioner is that after death of complainant's husband, who happens to be the elder brother of the petitioner, she wanted to marry the petitioner and when he and his parents refused, therefore, he has been falsely implicated in this case.

No.48633 of 2018(2) dt.09-08-2018 2/2 Having considered the aforesaid facts and circumstances, the petitioner, namely, Mithun Rai is directed to be released on bail upon furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the learned ACJM14th, Saran at Chapra in connection with Garkha P.S.Case. No. 241 of 2018.
