2. Petitioner apprehends arrest in a case registered for the offences punishable under Section 7 of the Essential Commodities Act.

3. According to F.I.R., on the alleged date and time of occurrence, on the basis of secret information, a raid was conducted in the house of this petitioner and 834.7 Kg rice was recovered which was allegedly kept for black marketing.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. As a matter of fact, petitioner is a farmer and engaged in sale and purchase of foodgrains and has purchased the aforesaid rice from small vendors for resale. Petitioner is not a PDS dealer and as such, the rice in question cannot be said to be kept for black

5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Siwan in connection with GoreyaKothi P. S. Case No. 233 of 2024, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
