2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30 (a) of Bihar Prohibition and Excise Amendment Act 2022 .
3 . It is alleged that 1100 ml illicit liquor was recovered from seized vehicle and petitioner is alleged to be owner of the seized vehicle .
4. It is submitted that the petitioner is innocent and has falsely been implicated in this case . As a matter of fact, the driver of the seized vehicle without knowledge and consent of this petitioner used the vehicle in transporting the alleged liquor. Petitioner has got no concern with the alleged recovery and she was not present at the time of occurrence . No incriminating
Patna High Court CR. MISC. No.49729 of 2025(2) dt.22-07-2025 2/2 material has been recovered from the conscious possession of the petitioner. Petitioner is lady and claims clean antecedent. 5 . Learned counsel for the State opposes the bail petition .
6. Considering the quantity of recovery , clean antecedent of petitioner and other circumstances of the case , in the event of arrest/surrender within six weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned special Judge Excise Patna City in connection with Bahadurpur Police Station Case No. 52 of 2025 , subject to the conditions laid down under section 482 ( 2 ) of the Bharatiya Nagarik Suraksha Sanhita ( BNSS) , 2023 .
