The petitioner seeks bail in a case registered under Sections 341, 323, 147, 148, 149, 307 of the Indian Penal Code and Section 27 of the Arms Act.

The prosecution case, in short, is that while the informant was keeping straw in his house, he heard sound of Maro maro with abusing. He moved and in the meantime, the petitioner is alleged to have fired upon the informant. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 25-05-2019. Charge sheet in this case has already been submitted. There is admitted

Patna High Court CR. MISC. No.49047 of 2019(2) dt.06-08-2019 2/2 land dispute between the parties. The victim has not sustained injuries to the alleged occurrence. It has further been submitted that the petitioner may be released after completion of six months in custody.

On behalf of the State and O.P. No. 2 , it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that after completion of six months in custody, the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Rajesh Kumar Singh, learned Judicial Magistrate-Ist Class, Court No. 4, Buxar or its available successor Court in connection with Murar P.S. Case No. 36 of 2019.
