The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 354D,(ii) of the IPC and Section 66C of the IT Act and under Section 12 of the POCSO Act.

As per prosecution case, the allegation against unknown miscreant is that he after hacking the FB id of the informant's daughter, crated a page i.e. about sex due to which her family members started receiving many calls from unknown numbers.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The

No.54211 of 2023(2) dt.28-08-2023 2/2 informant is own father-in-law of the petitioner and due to family dispute between her daughter and the petitioner, he has falsely been implicated in this case. The petitioner is not named in the FIR and he has got no criminal antecedent. It is further submitted that during investigation no consistent material has come out against the petitioner. Moreover, he is languishing in judicial custody since 02.06.2023. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Ghosi Okri P.S. Case No. 222 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VI-cum Special Judge, POCSO, Jehanabad..
