The petitioner apprehends his arrest in a case under Section 304(B) and other sections of the Indian Penal Code. The father of the deceased made allegation that he married his daughter Sushma Kumari on 08.06.2013 with Shree Mahto, the brother of the petitioner, but on 06.09.2013, her half burnt dead body was recovered from a river. It is alleged that the petitioner was torturing the deceased due to non-fulfillment of demand of dowry. It is submitted that the petitioner is the elder brother of the husband of the deceased and he has no manner of concern with the affairs of the deceased and her husband. The petitioner is working in AMIGO Surgi-Care Pvt. Ltd, Gandhinagar, Gujarat and a certificate to this effect is also annexed as Annexure-2.
Patna High Court Cr.Misc. No.16525 of 2015 (3) dt.02-07-2015 2/2 There appears that the informant made allegation against the petitioner and other family members that they all were torturing his daughter. The daughter of the informant was killed within three months of her marriage and her dead body was thrown in a river.
Considering the facts aforesaid, I am not inclined to enlarge the above named petitioner on anticipatory bail in Morhowrah P.S. Case No. 271/13. Accordingly, the same is rejected.
