The petitioners seek bail in a case registered under Sections 399, 400, 401, 402, 413/34 of the Indian Penal Code and 25(1-b), 26, 35 of the Arms Act.

Allegation is that one country made pistol is recovered.

It has been submitted on behalf of the petitioners that the petitioners are in custody since 13.02.2019 and have got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged

Patna High Court CR. MISC. No.50139 of 2019(2) dt.13-08-2019 2/2 against the petitioners. One country made pistol is alleged to have been recovered from petitioner No.1. No arms is alleged to have been recovered from petitioner Nos.2 and 3. On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Darbhanga in connection with Sadar (Bhalpatti O.P.) P.S. case No.59 of 2019.
