JUSTICE PRABHAT KUMAR JHA ORAL ORDER 05-05-2015 Heard Mr. Ajay Thakur, learned counsel for the petitioner and learned counsel for the State. The petitioner apprehends his arrest in Gaighat P.S. Case No. 362 of 2014, registered for the offence punishable under Section 379 of the Indian Penal Code.
The petitioner is of course not named in the FIR, but during the course of investigation, Rahul Kumar and Shailu Kumar made their confessional statement disclosing the name of the petitioner and others.
Learned counsel for the petitioner submits that it is a case of theft of a motorcycle and the name of the petitioner figured in the case in the confessional statement of co-accused but the accused persons in their confessional statement disclosed different

Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
